What is the Privacy Act of 1974?The Privacy Act of 1974, as amended, (“Privacy Act” or “the Act”) (5 U.S.C. 552a), Public Law 93-579, provides safeguards against the misuse of records Federal agencies maintain about individuals. In general, the Act requires federal agencies to publish information explaining how records about individuals are collected, maintained, used, and disseminated by the Federal Government. Subject to certain exceptions, the Privacy Act also permits individuals to gain access to their records which are maintained in a system of records and to seek amendment of any incorrect or incomplete information contained in those records. What is a System of Records?A system of records is a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifier assigned to the individual. What is a System of Records Notice?The Privacy Act requires that each agency that maintains a system of records must publish a notice in the Federal Register that identifies the purpose for which information about an individual is collected, from whom and what type of information is collected, how the information is shared with individuals and organizations outside/external to Treasury (routine uses), and what an individual must do if they want to access and/or correct any records Treasury maintains about them. These notices are commonly referred to as “systems of records notices” or “SORNs.” What is a Government-wide SORN?Typically, a federal agency publishes its own SORNS for the systems of records it maintains. Certain Federal agencies, however, have the subject matter expertise with respect to particular systems of records that are commonly maintained by all federal agencies. These Federal agencies have the responsibility for using their expertise to publish one or more SORNs which are applicable to all Federal agencies on a Government-wide basis. These SORNS are referred to as “Government-wide SORNs.” There are eight federal agencies responsible for publishing Government-wide SORNs. If a Treasury bureau or office maintains a system of records covered by a Government-wide SORN, they do not need to publish their own SORN to cover these records. What is a Treasury-wide SORN?Typically, Treasury bureaus and offices publish their own SORNS for systems of records they maintain that are unique to a Treasury mission. At Treasury, some systems of records are not covered by a Government-wide SORN, but the records are of a type commonly maintained by all (or most) Treasury bureaus and offices. In these cases, Treasury publishes a single SORN to cover the maintenance of these systems of records by all Treasury bureaus and offices that maintain these records. These SORNS are referred to as “Treasury-wide SORNs.” If a Treasury bureau or office maintains a system of records covered by a Treasury-wide SORN, they do not need to publish their own SORN to cover these records.
